Terms & Conditions
1. About these Terms
These Terms & Conditions govern access to and use of PEQUEDU and form the contractual terms between PEQUEDU and the person who creates and controls a PEQUEDU account.
By creating a PEQUEDU account, the account holder confirms that they have read and accepted these Terms & Conditions.
If you do not agree with these Terms, you must not create or use a PEQUEDU account.
These Terms should be read together with the PEQUEDU Privacy Policy and Cookie Policy.
2. Who provides PEQUEDU?
PEQUEDU
Calle Riu Gorgos 3
03750 Pedreguer, Alicante
Spain
NIF/NIE: X2266810E
Email: support@pequedu.com
PEQUEDU is an online language-learning platform providing educational activities, games, learning content and related digital features.
3. The PEQUEDU account
PEQUEDU accounts are created and controlled by an adult.
The person who registers the account is the account holder and is responsible for:
- providing accurate registration information;
- keeping their login information secure;
- managing the account;
- managing the Profiles associated with the account;
- ensuring that use of the account complies with these Terms; and
- ensuring that people using the Profiles do so appropriately.
An account may contain up to three Profiles.
Profiles are part of the account and are not separate PEQUEDU accounts.
4. Profiles
The account holder may create and manage up to three Profiles.
A Profile may contain a display name and selected PEQUEDU avatar.
The display name does not have to be the user's real name.
PEQUEDU does not require a Profile to contain a date of birth, age, email address, telephone number, physical address or payment information.
Profiles may be used by children, adults or other people authorised by the account holder.
The account holder is responsible for deciding who may use each Profile.
Certain account or Profile-management functions may require the account holder's passcode.
5. Children and younger users
PEQUEDU uses an adult-controlled account model.
Children do not independently register PEQUEDU accounts.
The adult account holder creates and controls the Profiles used within the account.
The account holder is responsible for supervising use of PEQUEDU by children or other younger users and for ensuring that the service is used appropriately.
PEQUEDU does not require a child's age or date of birth to create a Profile.
6. PEQUEDU Premium
Certain PEQUEDU functionality and content is available only to users with an active Premium entitlement.
Premium access is associated with the adult account rather than with an individual Profile.
While the account has a valid Premium entitlement, the authorised Profiles within that account may access the Premium functionality made available under the applicable plan.
PEQUEDU may change, improve, add or remove individual educational activities or features from time to time, provided that this does not unlawfully deprive consumers of their contractual rights.
7. Registration
To create an account, the account holder must complete the PEQUEDU registration process.
The registration process may require:
- an email address;
- a password;
- confirmation of the email address;
- acceptance of these Terms & Conditions;
- acknowledgement of the Privacy Policy;
- completion of the PEQUEDU security verification process; and
- other information reasonably necessary to create and secure the account.
The account holder must provide information that is accurate and must not knowingly register using another person's identity or email address without authorisation.
8. Email verification and account security
PEQUEDU may require email verification before an account can be fully activated.
This helps confirm that the account holder has access to the email address supplied during registration.
The account holder is responsible for keeping their password and account credentials confidential.
If the account holder believes that someone has obtained unauthorised access to their account, they should contact PEQUEDU promptly at:
support@pequedu.com
9. CAPTCHA and security measures
PEQUEDU may use CAPTCHA and other technical security measures to prevent automated registration, abuse, fraud and attacks against the service.
Users must not attempt to circumvent or disable such security measures.
PEQUEDU may temporarily restrict registration or account activity where reasonably necessary to protect the service.
10. Subscription plans
PEQUEDU offers monthly, six-month and annual subscription plans. The Founding 500 is a special annual plan subject to the eligibility rules below.
The applicable subscription price, billing interval, trial conditions and other commercial details are displayed to the customer before the subscription is completed.
The price displayed during the applicable checkout process is the price that applies to that subscription.
PEQUEDU may introduce, modify or discontinue subscription plans for future customers, subject to applicable law and the contractual rights of existing subscribers.
11. Fourteen-day free trial
PEQUEDU offers a 14-day free trial to eligible new memberships, subject to the applicable plan and eligibility rules. The commercial trial is available only once per family account.
Unless otherwise stated during checkout:
- the trial begins when the subscription is successfully created;
- Premium access is provided during the trial;
- no subscription charge is made during the free trial period; and
- after the trial ends, the subscription automatically continues as a paid subscription at the applicable price unless it has been cancelled in accordance with the cancellation terms.
A family that has previously used the PEQUEDU commercial trial is not entitled to a second commercial trial by cancelling, returning, renewing or creating another subscription.
The customer is responsible for cancelling the subscription before the trial ends if they do not wish the paid subscription to begin, subject to any mandatory consumer rights that apply.
The exact trial conditions displayed during checkout form part of the applicable subscription agreement.
12. Payment
Subscription payments are processed through Stripe.
PEQUEDU does not intentionally store complete payment-card numbers or card security codes in its own application database.
By subscribing, the customer authorises the applicable payment provider to process subscription payments according to the subscription selected during checkout.
Stripe may separately process payment information under its own terms and privacy documentation.
PEQUEDU receives information necessary to determine subscription and payment status.
13. Automatic recurring billing
Unless cancelled, a subscription automatically renews according to the billing interval selected during checkout.
For example, an annual subscription renews annually and a monthly subscription renews monthly.
The applicable renewal price is the price communicated to the customer in accordance with applicable law.
Where PEQUEDU changes the price of an existing subscription, the customer will receive any notice required by applicable law and will have any applicable cancellation rights.
14. Cancellation
The account holder may cancel their subscription in accordance with the cancellation options provided by PEQUEDU and/or Stripe.
Cancellation stops future recurring charges but does not ordinarily provide an automatic refund for a period that has already been paid for, except where a refund is required by law, the applicable subscription terms, or PEQUEDU expressly agrees otherwise.
Where a subscription has already been paid for a billing period, Premium access may normally continue until the end of that paid period unless the contract or applicable law requires otherwise.
A customer cancelling during the 14-day free trial will normally retain access for the remainder of the trial and will not be charged for the subsequent paid subscription, provided that cancellation is successfully completed before the trial ends.
15. Right of withdrawal
Consumers may have a statutory right of withdrawal when entering into an online subscription contract.
Where applicable, the statutory withdrawal period is generally 14 days from conclusion of the relevant contract, subject to the specific rules and exceptions applicable to the type of service and the circumstances of the contract.
Nothing in these Terms is intended to remove or restrict a mandatory statutory right of withdrawal.
Where PEQUEDU begins providing the digital service during a statutory withdrawal period, PEQUEDU may obtain the required consent, acknowledgement or other confirmation at registration and again at membership checkout where applicable, in accordance with applicable law.
Where the law permits withdrawal rights to be limited or excluded because the customer has expressly requested commencement of performance and has provided the legally required acknowledgement, the relevant PEQUEDU registration and/or checkout process will contain the appropriate information and consent.
Where a consumer exercises a valid withdrawal right, the consequences will be determined in accordance with applicable consumer law. PEQUEDU's operational withdrawal mechanism may immediately end the applicable Premium access; the account and learning progress are not deleted solely because withdrawal is exercised. Any refund is handled according to applicable law and the circumstances of the subscription and is not necessarily automatic.
16. Subscription cancellation is different from withdrawal
Cancellation of a subscription and exercise of a statutory right of withdrawal are separate legal mechanisms.
Cancellation is the ordinary subscription-management action. It stops the subscription from renewing, while Premium access normally continues until the end of the current trial or paid period, subject to the applicable subscription terms and law.
Withdrawal is the exercise of a statutory consumer right where applicable. Where a valid withdrawal is available and exercised through the PEQUEDU withdrawal mechanism, Premium access may end immediately. The account and learning progress are retained.
Any refund resulting from withdrawal is determined by applicable consumer law and the circumstances of the contract. A refund is not necessarily automatic.
Nothing in these Terms prevents a customer from exercising mandatory statutory rights.
17. Failed payments
If a subscription payment fails, Stripe may attempt to collect the outstanding payment according to its applicable billing procedures.
PEQUEDU may receive information about the failed payment.
If a subscription is no longer valid because payment cannot be successfully collected, PEQUEDU may restrict or suspend Premium access once the applicable entitlement has ended.
The account itself may remain available where appropriate, but Premium functionality will not remain available without a valid Premium entitlement.
18. Subscription status and Premium access
PEQUEDU determines Premium entitlement using subscription information received and verified through its payment infrastructure.
The browser, Profile or client application cannot independently grant itself Premium access.
If Stripe reports that a subscription has:
- expired;
- been cancelled;
- become unpaid;
- otherwise ceased to provide entitlement; or
- otherwise become invalid,
PEQUEDU may restrict Premium access accordingly.
The account holder may need to renew or establish a new valid subscription to regain Premium access.
19. Founding 500
PEQUEDU may offer a special Founding 500 subscription price to the first 500 qualifying paying customers.
The special Founding Member price is €74.99 per year as an annual recurring subscription. This founding price remains available while the membership remains active.
The Founding 500 is available only to families entering their first PEQUEDU membership. A family with any previous PEQUEDU subscription history is not eligible for Founding 500, even if it never previously held Founding status and even if Founding 500 places remain available.
The Founding 500 is intended for customers who become genuine paying subscribers. A registration, free trial or 100% promotional access by itself does not constitute a qualifying Founding 500 customer.
A qualifying Founding 500 place is based on the applicable successful paid subscription transaction and the rules communicated for the Founding 500 offer.
The Founding 500 offer may close automatically once all 500 qualifying places have been allocated.
Once the Founding 500 allocation has been exhausted, new customers will receive the applicable standard subscription pricing.
PEQUEDU may maintain records necessary to determine Founding 500 eligibility and allocation.
20. Founding status after cancellation
Founding status is a benefit associated with the qualifying Founding 500 subscription.
If a Founding 500 subscriber cancels their subscription, their Founding status is permanently lost.
If that person later creates or purchases a new subscription, they will not automatically regain the Founding 500 price or founding status.
They will instead be subject to the subscription price and conditions available to them at the time of resubscription.
This rule applies even where the original Founding 500 allocation has not otherwise been exhausted.
21. Promotion codes
PEQUEDU may offer promotion codes from time to time.
Promotion codes may provide:
- percentage discounts;
- fixed discounts;
- free subscription periods;
- 100% discounts; or
- other promotional benefits specifically stated when the code is issued.
Promotion codes may be subject to eligibility restrictions, expiry dates, usage limits, specific subscription plans, one-time use restrictions or other conditions.
The specific conditions presented with a promotion code apply to its use.
A promotion providing 100% free access is a promotional offer and is not the same as the PEQUEDU 14-day commercial trial. Promotional access does not reset or create a new commercial trial entitlement.
PEQUEDU may cancel or refuse a promotion code where it has been obtained, distributed or used fraudulently or contrary to its conditions.
22. Free promotional access
A promotion code may, where specifically configured, provide 100% discounted or otherwise free access.
A person receiving free access through a promotion code must nevertheless complete the applicable PEQUEDU registration and account-verification process.
Free promotional access does not automatically make a person a Founding 500 paying customer and does not consume a qualifying paid Founding 500 place unless the applicable Founding 500 conditions expressly state otherwise.
Free promotional access is separate from the 14-day commercial trial and does not create or reset a commercial trial entitlement.
23. Refer & Earn €5
PEQUEDU may provide an optional referral programme for active Premium members.
An eligible active Premium member may receive a unique referral link leading to the PEQUEDU homepage. The referral link may be shared with another person.
A referral qualifies only when the referred family is a genuinely new PEQUEDU customer and completes its first successful paid payment for a qualifying membership: the six-month, annual or Founding 500 plan. A monthly membership does not qualify.
A click, registration, email verification or trial by itself does not qualify a referral.
For each successful qualifying referral, the referring member receives a €5 membership credit applied through the applicable Stripe customer balance. The credit is not a cash payment.
There is no stated limit on the number of successful referrals. Self-referrals are prohibited, and an existing PEQUEDU customer cannot become a referral through a referral link.
If the referred membership is cancelled or withdrawn before the qualifying payment is successfully completed, no referral reward is earned. Where a qualifying payment is subsequently refunded or reversed, PEQUEDU may reverse the associated referral credit.
PEQUEDU may apply reasonable controls to prevent fraud, abuse or manipulation of the referral programme.
24. Educational nature of PEQUEDU
PEQUEDU provides educational and language-learning content.
PEQUEDU is intended to support learning and practice but does not guarantee a particular educational result, language level, examination result or academic outcome.
Learning outcomes vary between individuals.
PEQUEDU should be used as an educational resource and does not replace professional educational, medical, psychological or other specialist advice.
25. Availability of the service
PEQUEDU aims to provide a reliable service but cannot guarantee that the website or every feature will be continuously available without interruption.
Temporary interruptions may occur because of:
- maintenance;
- technical failures;
- hosting or infrastructure problems;
- security incidents;
- third-party service failures;
- internet or telecommunications failures; or
- circumstances outside PEQUEDU's reasonable control.
PEQUEDU will take reasonable steps to restore affected services where practicable.
26. Changes to PEQUEDU
PEQUEDU may develop and improve the service over time.
This may include:
- adding new educational content;
- improving games;
- changing visual designs;
- improving accessibility;
- introducing new features;
- correcting errors;
- improving security; or
- removing or replacing features that are no longer technically or commercially viable.
Where a change materially affects a customer's contractual rights or the conformity of the digital service, PEQUEDU will comply with the applicable legal requirements.
27. Account suspension or termination
PEQUEDU may suspend or terminate an account where reasonably necessary, including where:
- the account holder seriously breaches these Terms;
- the account is used fraudulently;
- the account is used for unlawful purposes;
- security of PEQUEDU or other users is threatened;
- the account is used to circumvent Premium access controls;
- payment obligations are not fulfilled;
- the account is used to abuse promotional offers; or
- PEQUEDU is legally required to do so.
Where appropriate and legally permissible, PEQUEDU will provide reasonable notice or an opportunity to remedy the breach before termination.
Nothing in this section limits mandatory consumer rights.
28. Prohibited use
Users must not:
- use PEQUEDU unlawfully;
- attempt to obtain unauthorised access to accounts or systems;
- circumvent Premium access controls;
- manipulate subscription status;
- exploit technical vulnerabilities;
- interfere with PEQUEDU's servers or infrastructure;
- introduce malicious software;
- attempt automated attacks or mass account creation;
- reverse engineer PEQUEDU except to the extent that applicable law expressly permits it;
- copy or redistribute PEQUEDU content without permission;
- use another person's account without authorisation; or
- use PEQUEDU in a manner that could damage the service or other users.
29. Intellectual property
PEQUEDU and its content are protected by applicable intellectual-property laws.
Unless expressly stated otherwise, PEQUEDU owns or has the necessary rights to use:
- the PEQUEDU name and branding;
- the LUMI character and related artwork;
- website designs;
- illustrations;
- educational content;
- games;
- software;
- graphics;
- audio;
- animations;
- text;
- databases;
- badges;
- room assets; and
- other PEQUEDU materials.
Access to PEQUEDU does not transfer ownership of any PEQUEDU intellectual property to the account holder.
The account holder receives a limited, personal, non-exclusive, non-transferable right to use PEQUEDU for its intended educational purpose during the period in which they are authorised to access the service.
30. User-generated information
The account holder may enter or create certain information within PEQUEDU, including Profile names and other information associated with use of the service.
The account holder remains responsible for ensuring that information they provide does not unlawfully infringe the rights of others.
PEQUEDU does not acquire ownership of a person's personal information merely because it is entered into the service.
Personal data is handled in accordance with the PEQUEDU Privacy Policy.
31. Technical requirements
Use of PEQUEDU requires a compatible device, browser, internet connection and any other technical requirements communicated by PEQUEDU.
The account holder is responsible for obtaining and maintaining the equipment and internet connection necessary to access PEQUEDU.
PEQUEDU is not responsible for connectivity problems caused by the user's device, internet provider or other infrastructure outside PEQUEDU's reasonable control.
32. Consumer rights and conformity
Nothing in these Terms limits mandatory consumer rights.
Where PEQUEDU provides a digital service to a consumer, applicable consumer-protection and digital-content/digital-service conformity rules apply.
If PEQUEDU fails to provide the service as required by applicable law, the consumer may have statutory remedies, which may include bringing the service into conformity, a price reduction or termination of the contract in circumstances established by law.
These statutory rights apply independently of any voluntary customer-support or refund policy offered by PEQUEDU.
33. Refunds
Where a customer is legally entitled to a refund, PEQUEDU will provide the refund in accordance with applicable law.
Where a refund is not legally required, any discretionary refund will be considered according to the circumstances and PEQUEDU's applicable commercial policy.
Nothing in this section limits statutory withdrawal rights, conformity rights or other mandatory consumer protections.
Where Stripe is responsible for processing a payment, the refund may be processed through Stripe or another appropriate payment mechanism.
34. Customer support
Questions concerning PEQUEDU, accounts, subscriptions or technical problems can be sent to:
support@pequedu.com
PEQUEDU will make reasonable efforts to respond to support requests.
For technical problems, users should provide enough information to allow PEQUEDU to investigate the issue.
35. Complaints and opportunity to resolve issues
If you believe that PEQUEDU has failed to comply with these Terms or applicable law, we encourage you to contact:
support@pequedu.com
before commencing formal proceedings where legally permissible.
This gives PEQUEDU an opportunity to investigate the matter and, where appropriate, correct or resolve the issue promptly.
Nothing in this section limits any statutory right to bring a complaint before a competent authority, consumer-protection body, court or other competent institution.
36. Limitation of liability
To the maximum extent permitted by applicable law, PEQUEDU will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside PEQUEDU's reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, nothing in these Terms limits liability for matters that cannot legally be excluded or limited under applicable consumer or other mandatory law.
37. Events outside reasonable control
PEQUEDU will not be responsible for failure or delay caused by circumstances reasonably outside its control.
Such circumstances may include:
- major internet failures;
- hosting-provider failures;
- widespread infrastructure failures;
- cyberattacks;
- natural disasters;
- war;
- governmental action;
- strikes or labour disruption;
- failures of third-party services;
- electricity or telecommunications failures; or
- other events that could not reasonably have been prevented or overcome.
PEQUEDU will take reasonable steps to restore affected services where practicable.
38. Assignment and transfer
The account holder may not transfer or sell their PEQUEDU account or subscription to another person without PEQUEDU's prior written consent.
PEQUEDU may transfer or assign its rights and obligations where permitted by applicable law, including in connection with a corporate restructuring, sale or transfer of the PEQUEDU business.
Where legally required, affected customers will be informed.
39. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The invalid provision will be interpreted or replaced to the extent necessary to achieve, as closely as legally possible, the intended purpose of the original provision.
For consumers, mandatory statutory provisions take precedence over any conflicting contractual provision.
40. No waiver
Failure by PEQUEDU to enforce a provision of these Terms does not constitute a waiver of that provision or of PEQUEDU's right to enforce it later.
Any waiver must be understood in accordance with applicable law and does not automatically constitute a permanent waiver of future enforcement.
41. Changes to these Terms
PEQUEDU may update these Terms where reasonably necessary, including because:
- the service changes;
- new features are introduced;
- subscription plans change;
- legal requirements change;
- security requirements change; or
- other legitimate operational reasons require an update.
The current version will be made publicly available through PEQUEDU.
Where a change materially affects an existing customer's contractual rights, PEQUEDU will provide any notice required by applicable law and, where required, obtain renewed agreement.
The document version and update date are displayed at the beginning of these Terms.
42. Language versions
PEQUEDU provides these Terms & Conditions in:
- English
- German
- Spanish
- Valencian
English is the master language version used by PEQUEDU for the interpretation of these Terms.
Translations are provided to make the Terms accessible to users in the languages supported by PEQUEDU.
Nothing in this language provision removes or limits any mandatory consumer protection or legal right applicable to a customer.
43. Governing law
These Terms are governed by the laws applicable to PEQUEDU's business and, where the account holder is a consumer, by the mandatory consumer-protection rules applicable to that consumer.
For consumers residing in the European Union, mandatory protections provided by the law of their country of residence remain unaffected where applicable.
Nothing in these Terms is intended to deprive a consumer of mandatory rights granted by applicable law.
44. Jurisdiction and dispute resolution
Where the account holder is a consumer, any mandatory jurisdiction rules protecting consumers will apply.
Consumers may have the right to bring proceedings before the courts of their place of residence or another competent court as provided by applicable law.
Where permitted by law, disputes involving PEQUEDU may otherwise be subject to the competent courts in Spain.
Nothing in this section prevents a consumer from exercising any statutory right to use an alternative dispute-resolution mechanism or to bring a complaint before a competent consumer-protection or supervisory authority.
45. Contact before formal proceedings
If you believe that any aspect of PEQUEDU does not comply with these Terms or applicable law, we strongly encourage you to contact:
support@pequedu.com
before initiating formal proceedings or other enforcement action where legally permissible.
PEQUEDU will have the opportunity to investigate the matter and, where appropriate, correct or resolve the issue.
This is intended to encourage efficient and constructive resolution of genuine issues.
Nothing in this provision requires a consumer to contact PEQUEDU before exercising a statutory right, filing a complaint with a competent authority, commencing proceedings within a mandatory deadline, or exercising any other legal remedy that cannot lawfully be made conditional on prior contact.
46. Entire agreement
These Terms, together with the PEQUEDU Privacy Policy, Cookie Policy and any specific subscription or promotional terms presented to the customer, form the contractual framework governing use of PEQUEDU.
If a specific subscription offer or promotion contains terms that expressly apply to that offer, those specific terms will apply to the extent they conflict with general provisions of these Terms.
Mandatory provisions of applicable law always take precedence.
47. Final provision
These Terms describe the PEQUEDU service and subscription model as operated at the time of publication.
PEQUEDU will maintain the service and its legal documentation in accordance with applicable law.
The current version of these Terms is publicly available through the PEQUEDU website.
